Terms of Service

1. The service

AlphaPine ("we", "us", "our") provides subscription access to the AlphaPine products — charting and analysis tools, some published to third-party charting platforms and some hosted by us and used in your browser (together, the "Service"). Which products a subscription includes is set out on our pricing page and may change over time. By purchasing a subscription or using the Service, you agree to these Terms.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction if that is higher, and legally able to enter into a subscription and payment agreement. By subscribing, you confirm that you meet these requirements and that the information you provide is accurate.

3. Not financial advice

The Service is provided for educational and informational purposes only — it is decision-support, not advice. AlphaPine is not a financial advisor, broker, or signal service, and nothing in the Service is financial, investment, legal, or tax advice, a recommendation, or a solicitation to buy or sell any financial instrument. No indicator or tool guarantees any trading outcome. Trading involves substantial risk of loss and is not suitable for everyone. You are solely responsible for your own trading decisions and for complying with the laws that apply to you.

4. Access and activation

AlphaPine products are delivered in one of two ways, and a subscription may include both.

Products published to a third-party charting platform are granted to the single platform username you submit at checkout, so an active account on that platform is required. Provide the username exactly as it appears there. We activate access normally within 24 hours after the required information is submitted. Those platforms are separate services with their own terms, and access is delivered through their own invite or entitlement workflow.

Products hosted by us run in your browser and are unlocked by signing in with the email address you paid with. Signing in creates an account keyed to that address; there is no password, and we email you a single-use sign-in link instead. If you pay with one address and sign in with another, your subscription will not appear — contact support and we will move it.

Access is personal and non-transferable in either case: sharing, reselling, or giving others the use of your access is not allowed and may lead to termination without a refund.

5. Subscriptions and billing

Subscriptions are billed in advance through Stripe on the billing period you chose at checkout, and renew automatically until cancelled. You can cancel at any time through the Stripe Customer Portal; your access then continues until the end of the period you have already paid for. Which AlphaPine products a subscription includes is set out on the pricing page at the time you subscribe. Prices, plans and the products in them may change; an existing subscription keeps the plan and the price it was sold at until you change it yourself, and we will give notice before any change takes effect at your next renewal.

6. Intellectual property

All indicators, scripts, code, documentation, design, and branding are and remain the property of AlphaPine, and the internal logic of the products is proprietary and confidential. Your subscription grants a limited, revocable, non-exclusive licence to use the AlphaPine products for your own trading, on your own account. You may not copy, reverse-engineer, decompile, redistribute, or create derivative works from the Service.

7. Availability and changes to the Service

We may add, update, improve, or discontinue individual products or features over time, including the market-data sources a hosted product reads from. We aim for continuous availability but cannot guarantee the Service will be uninterrupted or error-free, including where interruptions come from the charting platforms, payment providers, data sources, or other third parties we depend on.

8. Limitation of liability

To the maximum extent permitted by law, AlphaPine will not be liable for any trading losses, loss of profits, or indirect, incidental, or consequential damages arising from use of the Service. Our total liability for any claim is limited to the amount you paid for the Service in the twelve months before the claim. Nothing in these Terms removes any rights you have that cannot be limited under the law that applies to you.

9. Termination

We may suspend or terminate access if these Terms are breached, including access sharing or chargeback abuse. You can end your subscription at any time by cancelling through the Stripe Customer Portal.

10. Governing law

These Terms are governed by the laws of Malaysia, and the courts of Malaysia will have jurisdiction over any dispute. This does not remove any mandatory consumer protection you may have under the laws of your own country of residence.

11. Changes to these Terms

We may update these Terms from time to time — for example, to reflect changes to the Service, our providers, or the law. When we do, we will update the "last updated" date shown at the foot of this page. Continuing to use the website or the Service after an update takes effect means you accept the updated Terms.
